O objetivo deste artigo é apresentar uma argumentação sobre a possibilidade de se pensar a justiça como uma experiência do i m possível. Parte-se da distinção derridiana entre justiça e direito. Essa distinção trará algumas implicações no que tradicionalmente é entendido como ética. Partindo do jogo ou da différance marcada entre a presença/ausência, pretende-se estabelecer um ponto de diálogo entre Derrida e Levinas. O ponto de aproximação é a questão do terceiro na relação do face a face. Much controversy has emerged on the demarcation between legal positivism and non-legal positivism with some authors calling for a ban on the -as they see it- nonsensical labelling of legal philosophical debates. We agree with these critics; simplistic labelling cannot replace the work of sophisticated and sound argumentation. In this paper we do not use the term ‘legal positivism’ as a simplistic label but identify a specific position which we consider to be the most appealing and plausible view on legal (...) positivism. This is the view advocated by Gardner in his paper 'Legal Positivism: 5½ Myths’, where he carefully scrutinises the most convincing and unifying postulates of legal positivism, which he calls “the thin view”. The study shows that this thin view presupposes an empirical conception of action that is untenable and implausible since it makes acts of engagement with the law unintelligible to an observer of such acts. AntecedentsPrevious research on citizens’ reactions after terrorist events has shown that positive reactions can also emerge alongside pain and horror. Positive emotions have been widely associated with an abstract style of thinking. In the context of the Paris terrorist attacks in 2015, we explored Spanish citizens’ positive reactions – empathic concern, positive emotional climate, and esteem for humanity – and examined the relationships of these responses with an abstract style of thinking.MethodA longitudinal study was designed involving an online questionnaire that (...) was administered 10 days, 3 weeks, and 2 months after the attacks.ResultsEmpathic concern and personal distress toward Parisians decreased from the weeks following the attacks to 2 months later, with empathic concern always being more intense than personal distress. Emotional climate was perceived as more hostile than positive, although positive feelings persisted. People reported moderately positive esteem for humanity. Individuals with a more abstract style of thinking reported greater empathic concern, a more positive emotional climate, and more esteem for humanity.ConclusionsOur results support and extend previous research showing that abstraction enhances people’s resilience, even under traumatic circumstances such as those surrounding a terrorist attack. Individuals living with rare conditions are faced with important challenges derived from the rarity of their conditions and aggravated by the low priority given to rare disease research. However, current realities of rare disease research require consideration of the relationship between subjectivity and ‘traditional’ objectivity. Objectivity in research has traditionally been associated with processes and descriptions that are independent of the investigator. The need for researchers to provide unbiased knowledge and achieve a balance between objectivity and the underlying values in (...) nursing and scientific research requires an examination of how objectivity is conceptualized within the context of rare disease research. The aim of this paper is to examine scientific objectivity in rare disease research from a philosophical viewpoint and, in doing so, demonstrate the need to redefine it to reflect the current scientific environment. As such, healthcare providers working on this field need to redefine objectivity around ethical and moral obligation to advance science in an equitable manner with the end goal to produce knowledge that is trustworthy and beneficial to our patients. Research on salesperson creativity remains as one of the most under-researched topics in the sales literature despite the evidence that encouraging creativity in the sales domain is a source of competitive advantage. This paper aims to fill this research gap by exploring the influence of perceived ethical climate on salesperson creative performance, paying special attention to the role that emotions play in this process. Data provided by 176 supervisor–salesperson dyads confirm that the trust/responsibility dimension of an ethical climate is positively (...) related to salesperson creative selling by increasing salespeople's organizational pride. Similarly, the perception of unethical selling practices negatively affects salesperson organizational pride, reducing the expression of creative behaviors. Moreover, the negative effect of unethical selling practices on creative performance is stronger (more negative) when salespeople's identification with an organization increases. Resumen. El siguiente artículo muestra el estado actual de la Responsabilidad Empresarial enMéxico y su efecto en el Riesgo medido a través del Costo de Capital. Para ello, revisamos lasprincipales teorías que muestran que el uso de prácticas sociales en Estados Unidos provocandisminución del riesgo y por ende del Costo de Capital, Aras y Crowther, Richardson yWelker y Diamond y Verrechia. Con el fin de contrastar que las empresas SocialmenteResponsables tienen costos de capital menores consideramos como variable de desempeño social (...) eldistintivo que otorga el Centro Mexicano de Filantropía y por otra parte para calcular elriesgo consideramos el costo de capital a través de la metodología del Capital Asset Price Modelo. Encontramos que las empresas que son socialmente responsables tienen costos de capitalsuperiores que las que no son responsables y que el rendimiento de acciones es superior en lasempresas no responsables, por lo que el diferencial de riesgo vs rendimiento es superior en lasempresas no socialmente responsables. The following article shows the current status of the corporate responsibility inMexico and their effect on risk measured by the cost of capital. To do this, we review the maintheories that show that social practices in the United States leads to decrease risk and hence the costof Capital Aras and Crowther, Richardson and Welker and Diamond y Verrechia. In order to contrast that socially responsible companies have lower capital costs we considersocial performance variable the distinction conferred by the Mexican Center for Philanthropy and the cost of capital it estimate on the methodology of the Capital Asset Price model. We find that companies that are socially responsible have capital costs higher than thosethat are not responsible. Objectives To develop and test two educational programmes (interactive and passive) aimed at improving family doctors' (FD) prescribing practices and patient's knowledge and use of non-opioid analgesics (NOA).Methods The educational programmes were conducted in two family medicine clinics by using a three-stage approach: baseline evaluation, design, and implementation of educational activities, and post-programme evaluation. An interactive educational programme (IEP) was compared with a passive educational programme (PEP); both were participated by FDs and patients. The IEP for FDs comprised of workshops, (...) discussion groups, in-service training and guidelines, while for patients the IEP consisted of an interactive session with a video, leaflets and a discussion. The PEP consisted in delivering the guidelines to the FDs and the leaflets to patients. The effect of the programmes on the FDs was measured through the appropriateness of prescriptions and analysed using the differences-in-differences estimator (D-in-D), and on patients through changes in self-medication and in their knowledge about the proper use and adverse events by analysing the inter- and intra-group differences before and after the programmes.Results The IEP obtained better results to improve appropriate FDs prescription of NOA than PEP (D-in-D = 15%). Regarding the patients, the PEP group reached higher reduction of self-medication than the IEP group (13.4% vs. 9.1%); the knowledge of proper NOA use increased by 8.5% in both groups, whereas knowledge of NOA-related adverse events was better in the IEP (39.6%) than in the PEP group (9.2%).Conclusions The IEP was better to improve the doctors' abilities to prescribe NOAs, and both programmes improved patients' knowledge. Since the 1800s, nursing practice and research have covered a wide scope in cooperation with other disciplines. This wide area of nursing practice and research has led to the proposal that the central question be: How can the well‐being of a person, family, community, or population be improved? A key issue in the business ethics field is the design of effective measures for assessing the ethical culture of organizations. The Corporate Ethical Virtues Model (CEV), developed by Kaptein in 2008, is an instrument for measuring ethical culture, and has been applied, adapted and validated in different contexts. In 2013, DeBode, Armenakis, Field and Walker developed the CEV–S, a shortened version of the original scale. Both the CEV and CEV–S assess eight dimensions based on corporate ethical virtues: clarity, congruency (...) of supervisors, congruency of senior management, feasibility, supportability, transparency, discussability and sanctionability. The objective of this study is to present a Spanish version of the CEV–S and its validation process. The scale was applied to two samples of 114 and 193 Colombian employees from two companies operating in the services sector. The confirmatory factor analyses revealed a good fit for the eight-factor structure of the Spanish CEV–S and the statistical tests applied showed good levels of reliability and validity for this scale. The adequate psychometric properties shown by the Spanish CEV–S may support its use in future research to measure organizational ethical culture in Spanish-speaking settings. (shrink)

Digital humanities research has developed haphazardly, with substantive contributions in some disciplines and only superficial uses in others. It has made almost no inroads in philosophy; for example, of the nearly two million articles, chapters, and books housed at philpapers.org, only sixteen pop up when one searches for ‘digital humanities’. In order to make progress in this field, we demonstrate that a hypothesis-driven method, applied by experts in data-collection, -aggregation, -analysis, and -visualization, yields philosophical fruits. “Call no one happy until (...) they are dead.” “De mortuis nil nisi bonum.” These ancient norms still inform how we speak of the dead. From their beginnings in the nineteenth century, modern obituaries have been both practical and honorary. They are written with two aims: to pay respect to the deceased and to inspire the living to follow in their footsteps. The obituary of William Custis of Virginia exemplifies these aims, say that “it is due to his memory publicly to record his virtues,” and that “There is in the life a noble, independent and honest man, something so worthy of imitation, something that so strongly commends itself to the approbation of the virtuous mind, that his name should not be left to oblivion” (Daily National Intelligencer, 18 November 1838). Likewise, philosophers have emphasized that we can determine what counts as a virtue for a given type of person in a given community by analyzing what people say about the dead (Zagzebski, L. Virtues of the Mind. Cambridge University Press, 1996, p. 135). By adhering to norms of praise, admiration, and respect, obituaries reveal what counts as a virtue, value, or constituent of wellbeing (VVC) for a particular type of person in a particular community. -/- One way to explore this insight would be to close-read a small number of obituaries of people from intersecting demographics, crossing dimensions such as gender, age, race, class, educational attainment, veteran status, religion, and location. Another, which we demonstrate in this chapter, is to harness digital humanities resources to distance-read a much larger number of obituaries, extracting both demographic meta-data and first-order content expressive of VVC. We then analyze and visualize this information to establish the structures of VVC associated with different types of people in different communities, arguing that data-science measures such as eigenvector centrality can be used to identify cardinal virtues. We also explain the rudiments of our text- and meta-data mining, our method of aggregating and comparing texts, and our visualization techniques. In so doing, we pave the way for researchers in philosophy and related fields to generate similar analyses and visualizations. (shrink)

En este sentido, el análisis de los escenarios de convivencia urbana implica redescubrir las historias viejas y nuevas de la inmigración, de la construcción del barrio, de la conformación de sus actores colectivos y de los espacios urbanos comunes. En el análisis de los escenarios de convivencia más conflictivos, encontramos giros discursivos que buscan responsabilizar a la inmigración reciente de problemáticas estructurales que se viven como irremediables. El escenario de convivencia social parece construirse desde acciones que buscan la implicación e interrelación entre los actores, desde el conocimiento y reconocimiento de las diferencias y con acento en los derechos comunes. Ozone is one of the pollutants with most negative effects on human health and in general on the biosphere. Many data-acquisition networks collect data about ozone values in both urban and background areas. Usually, these data are incomplete or corrupt and the imputation of the missing values is a priority in order to obtain complete datasets, solving the uncertainty and vagueness of existing problems to manage complexity. In the present paper, multiple-regression techniques and Artificial Neural Network models are applied to (...) approximate the absent ozone values from five explanatory variables containing air-quality information. To compare the different imputation methods, real-life data from six data-acquisition stations from the region of Castilla y León are gathered in different ways and then analyzed. The results obtained in the estimation of the missing values by applying these techniques and models are compared, analyzing the possible causes of the given response. (shrink)

This study presents the application of self-organizing maps to air-quality data in order to analyze episodes of high pollution in Madrid. The goal of this work is to explore the dataset and then compare several scenarios with similar atmospheric conditions : some of them when no actions were taken and some when traffic restrictions were imposed. The levels of main pollutants, recorded at these stations for eleven days at four different times from 2015 to 2018, are analyzed in order to (...) determine the effectiveness of the anti-pollution measures. The visualization of trajectories on the self-organizing map let us clearly see the evolution of pollution levels and consequently evaluate the effectiveness of the taken measures, after and during the protocol activation time. Providing nursing care for people with dementia residing in long-term care facilities poses specific challenges regarding pain practices. With underlying communication barriers unique to dementia pathologies, this population is often unable to communicate verbal sentiments and descriptions of pain. In turn, nurses caring for older persons with dementia have difficulty assessing, managing and treating pain. Objectivity is an imperative factor in healthcare pain practices; however, it is difficult to objectively evaluate someone who cannot accurately communicate their experience of pain. Therefore, (...) the authors believe that subjectivity is also an essential part of evaluating the person with dementia's experience of pain. In this critical reflection, the authors explore objectivity and subjectivity in relation to pain practices for dementia in long-term care. A historical summary of pain is provided outlining the evolution of objectivity and subjectivity related to pain practices. The authors discuss the complexities of assessing and managing pain and offer a new perspective about the role of objectivity (and co-existence of subjectivity) for nurses treating pain in the older adults with dementia. Ever so often in the UK, there is a flurry of activity around the information requirements of donor-conceived individuals. In April 2013, it was the launch of a report from the Nuffield Council on Bioethics that brought the issue back to public consciousness.1Since 1991, information about treatment with donor gametes or embryos has been collected by the Human Fertilisation and Embryology Authority. Since then, over 35 000 donor-conceived individuals have been born through treatment in licensed clinics. Medical information and information (...) about donors’ appearance are collected by clinics, and donors are encouraged to put together a ‘pen portrait’ giving information about themselves for any resulting children. One focus of the new report is on improving the quality and quantity of information available about donors.Traditionally, gamete and embryo donations were practised on an anonymous basis, so that those born as a result of such donation may receive only non-identifying information about the donor when they reach the age of 18. This changed in 2005 when donor anonymity was removed so that anyone donating after that time could be identified to individuals born as a result of the treatment. Those who have donated in the past are also able to reregister as identifiable donors. Much concern was expressed at the time that this would exacerbate the shortage of donors although the Nuffield Council on Bioethics reports that, 8 years on, those clinics that actively recruit donors appear to be successful in finding sufficient donors. On 7 April 2022 – coinciding with World Health Day – the British Medical Association launched its new report, Health and human rights in the new world order.1 Written during the global upheaval triggered by the COVID-19 pandemic, and published just weeks after the Russian invasion of Ukraine, the report responds to a range of emerging and intensifying threats to health-related human rights globally. As the report establishes, human rights in health and healthcare matter because human suffering, and its relief, (...) are fundamental moral issues. As relief of human suffering is the primary purpose of medicine, it follows that doctors and other health professionals are often active in times of human challenge and extremity. During conflict, humanitarian crises, and, as we have so recently seen, global public health emergencies, health professionals are essential to the response. But these crises – and the response to them – can put fundamental human rights and interests under pressure. The Russian invasion of Ukraine has seen sustained indiscriminate shelling of civilian infrastructure. Whether health facilities were directly targeted is moot – the indiscriminate nature of the assault means they will inevitably be hit. Not only is this a violation of the Geneva Conventions, it undermines fundamental human rights, not least of which the right to health. Destroying health infrastructure drives further suffering and delays post-conflict recovery. Public heath emergencies can rightly require draconian measures – social distancing, enforced isolation, location tracking, economic shutdown. Although we saw their necessity during the COVID-19 outbreak, concerns were raised about disproportionate restrictions on basic rights, including rights to privacy and liberty. Human Rights Watch drew attention to the way governments unlawfully exploited COVID-19 to crack down on fundamental rights.2 Although conflicts and public health emergencies are not new, the report also tracks a number of …. Watersheds constitute a special case of multiple-use common pool resources (CPRs). In a textual sense, watersheds tend to be mosaics of privately owned and managed patches of land. At the same time, however, watersheds are also ecosystems in which multiple resources and people interact through an infinity of bio-physical processes. Through such interaction, new watershed-level qualities emerge that, together with other factors, condition watershed users' continued resource use and access. In this perspective, watersheds become common-pool resources. Hence, watershed users do (...) not only manage their individual plots, crops, forests, etc., knowingly or not, they manage landscape patterns and bio-physical processes that transcend their private property. In this context, drawing on experiences gained through participatory action research in a micro-watershed in the Andean hillsides of southern Colombia, this paper describes a process aimed at fostering collective watershed management. The paper illustrates the importance of platforms as a mechanism for negotiating and coordinating collective action by multiple users and discusses the issues of representation on such platforms as well as the importance of third party facilitation. When efficiently used for action, tool becomes part of body, with effect on the spatial temporal movement parameters and body size perception. Until now, no previous investigation was reported about tool embodiment in Parkinson’s disease (PD), that is a neurological disease characterized by several sensory and motor symptoms affecting body and action. We enrolled fourteen individuals affected by PD and eighteen healthy individuals as controls. We studied the spatial-temporal parameters on self-paced free pointing movements task, via an optoelectronic system, before (...) and after a short training in which a 27 cm long rod was used to point toward a far target. Moreover, we investigated changes in estimation of arm length through the Tactile Estimation Task. After the tool use training, controls showed changes in spatial-temporal parameters: they were slower to perform movements and reported higher value of deceleration, respect to the baseline. However, such a difference did not emerged in the PD individuals. In the Tactile Discrimination Task, no difference emerged before and after the tool use training in both groups. Our results were suggestive of possible difficulties of tool embodiment process in PD. We discussed our results in relation to aberrant multisensory integration as well as in terms of the effect of PD sensory and motor symptoms on body schema plasticity. The present study points at a novel way to conceive PD sensory motor signs and symptoms, in terms of their effect on individuals’ body representation. (shrink)

Building on evidence for embodied representations, we investigated whether Spanish spatial terms map onto the NEAR/FAR perceptual division of space. Using a long horizontal display, we measured congruency effects during the processing of spatial terms presented in NEAR or FAR space. Across three experiments, we manipulated the task demands in order to investigate the role of endogenous attention in linguistic and perceptual space mapping. We predicted congruency effects only when spatial properties were relevant for the task but not when attention (...) was allocated to other features. Results showed faster responses for words presented in Near-space in all experiments. Consistent with our hypothesis, congruency effects were observed only when a reaching estimate was requested. Our results add important evidence for the role of top-down processing in congruency effects from embodied representations of spatial terms. (shrink)

At the outset of an ethnographic inquiry, we navigated national and international resources to search for theoretical and practical guidance on obtaining parents and children’s informed consent/assent. While much theoretical guidance debating ethical issues to children’s participation in research was found, a paucity of published papers offering practical guidance on assent processes and/or visual representations of child assent forms and information sheets was discovered. The purpose of this article is to describe our experiences, both theoretically and practically, of negotiating the (...) process of obtaining informed consent and assent with parents and children for a non-therapeutic qualitative research study. We hope this article instigates a platform for others to explicate their experience and contributes to the construction of a coherent body of knowledge which will clearly delineate important elements that must be considered when negotiating children’s agreement to participate in research.
